Accidents at work where there is a claim for damages for personal injury come under the jurisdiction of the Tribunal des Affaires de Sécurité Sociale.

Litigation involving rights and obligations connected to an employment contract or the rupture of an employment contract is dealt with by the French Employment Tribunal (Le Conseil de Prud’hommes).
The procedure in front of this court is in two phases. Parties are automatically invited to an obligatory conciliation process by the Bureau de Conciliation et d’Orientation. If conciliation succeeds then the litigious process comes to an end. If conciliation does not succeed then the second phase begins where the case will be sent for judgement.
